1. ACCEPTANCE OF TERMS
By using our website, booking services, or receiving treatments, you agree to these Terms of Service. If you do not agree, you may not use our services.
2. ABOUT OUR SERVICES
M.E.L.T. Myotherapy & Massage is a licensed massage therapy practice in Livonia, Michigan, providing therapeutic massage for wellness and relaxation purposes only. We do not provide medical treatment, diagnosis, or medical therapy. Our licensing can be verified through Michigan LARA.
3. ELIGIBILITY
- Clients must be 18+ to book independently
- Minors require a parent/guardian present during treatment
- Medical clearance may be required in certain circumstances
4. BOOKING AND PAYMENT
Booking: Appointments may be scheduled via our online system (Gloss Genius), phone, or email, subject to availability.
Payment: We accept cash, major credit cards, debit cards (including HSA cards), checks, and gift cards. Payment may be made at booking, in advance, or at time of service. Services are tax-exempt; products and ticketed events are taxable. An additional $35 fee will be invoiced if any payment is returned (bad checks). It is your responsibility to be able to provide back-up payment on the day of your appointment should a credit card transaction fail.
Pricing: Current rates are available on our website. We provide at least one week’s notice for price changes. Promotional offers and discounts have specific terms. Gift cards and packages have separate expiration dates.
Tipping: Tipping is never expected, but it is common practice and directly supports the therapist. You will be asked during check out if you would like to provide a tip which you can do via cash/check, Venmo or credit card. You cannot tip with an HSA card.
5. CANCELLATION/RESCHEDULING POLICY AND REFUNDS
Cancellations:
- **24-hour notice required** for all cancellations
- Late cancellations (less than 24 hours): 50% of appointment fee
- No-shows: 100% of appointment fee
- Fees must be paid same day as missed/cancelled appointment
- Account balances applied to cancellation fees first, then future services. You will be notified of an adjusted amount (not including tip)
Rescheduling:
- We understand you may need to reschedule, we ask that you try to give us as much advance notice as possible
-If you have cold/flu symptoms, communicable disease, or a fever you must reschedule. Showing up to your appointment with symptoms will result in paying for that time and not receiving service
-Rescheduling follows cancellation policy and fee structure for any changes to appointments less than 24 hour notice
- Rescheduling an appointment to another time outside regular business hours may incur fees (does not apply to client-initiated contact—text/email available 24/7, messages will be replied to during regular business hours)
-There may be times when your service provider may need to reschedule. You will receive a text and/or phone call, with a follow-up email that the appointment has been cancelled. We will make every effort to contact you immediately if there is any change to your appointment. Prepaid appointments will have to be rescheduled, please see our refund policy
Refunds:
- No refunds on gift cards or prepaid services
-No refunds on products (due to health related purchases)
-No refunds on services rendered due to dissatisfaction of service
-Refunds will only be given on services rendered if the amount charged is done in error and if it is higher than current service rate. In the event that you are charged incorrectly, notify us immediately and we will issue a correction (this is preferred to a credit card dispute as they are costly for the business). Refunds will not be given for discounts or promotional pricing amounts below the current service rate
- Service packages have separate terms as specified at purchase
- No-shows forfeit prepaid amounts
- Outstanding balances will be provided by no later than the date of the next scheduled appointment or 60 days from date of service
-Adjustments only apply to the cost of service and no adjustments will be made to tips
6. CLIENT RESPONSIBILITIES
You must:
- Provide accurate health information and disclose medical conditions, injuries, or medications
-Provide valid payment
- Arrive on time
- Report health status changes
- Follow pre/post-treatment recommendations
- Maintain appropriate behavior
Failure to disclose health information may result in treatment modification or cancellation with full payment due.
7. LATE ARRIVALS AND EXTENSIONS
- Arrive at your scheduled time (early arrivals may wait in lobby; early start not guaranteed)
- Appointment time includes up to 15 minutes for intake and checkout
- Arrivals over 10 minutes late may receive shortened treatment without fee adjustment
- Extensions subject to availability and charged at current rates
8. PROFESSIONAL CONDUCT
We maintain professional boundaries and provide a safe, respectful environment. We have zero tolerance for:
- Sexual harassment or inappropriate behavior
- Discrimination or hate speech
- Threats or aggressive behavior
- Drug or alcohol use on premises
Any illicit or sexually suggestive behavior, whether physical or verbal, will result in immediate termination of the session. You will be liable for the full scheduled appointment cost and may be reported to authorities. You will be considered “banned” from booking any future services.
The therapist and owner reserves the right to discontinue treatment at any point in the session for any reason not limited to the health and safety of themselves and or/the client. You may be “banned” without notice if the therapist determines they cannot provide a professional relationship for the highest good of all parties involved.
9. PRIVACY AND DATA USE
We collect personal and health information necessary for services, stored securely in compliance with HIPAA. We use third-party services (including but not limited to Acuity Scheduling, Stripe, Squarespace, Gloss Genius, AI tools) for operations and communications. You may opt out of marketing communications; service-related communications will continue.
10. INTELLECTUAL PROPERTY
All website content, marketing materials, and communications are property of M.E.L.T. Myotherapy & Massage or our licensors, protected by copyright and trademark laws.
11. LIMITATION OF LIABILITY AND ASSUMPTION OF RISK
Assumption of Risk: You acknowledge that massage services may involve risk of injury, discomfort, or adverse reactions. There are no guaranteed benefits from our services. You voluntarily receive services with knowledge of these risks and agree to accept and assume all risks arising from treatment.
Waiver and Release: You waive and release all claims against M.E.L.T. Myotherapy & Massage LLC, its owners, employees, and assigns for any injury, illness, discomfort, or property damage arising from services received, except as prohibited by law.
Limitation: To the maximum extent permitted by Michigan law, our liability is limited to the amount paid for services. We are not liable for indirect, consequential, or punitive damages, or for injuries from failure to follow recommendations.
Exceptions: We remain liable for death/injury from negligence, fraud, or matters where liability cannot be lawfully limited.
12. FORCE MAJEURE
We are not liable for service interruptions due to circumstances beyond our control (natural disasters, government orders, technical failures, etc.). We will reschedule appointments when possible.
13. MODIFICATIONS TO TERMS
We may modify these Terms at any time. Updated Terms will be posted on our website with the revision date. Continued use constitutes acceptance.
14. DISPUTE RESOLUTION
These Terms are governed by Michigan law. Disputes will be resolved in Wayne County, Michigan courts. Parties agree to attempt direct communication and mediation before pursuing legal action.
15. SEVERABILITY
If any provision is unenforceable, remaining provisions continue in full effect.
By booking an appointment or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
