## 1. ACCEPTANCE OF TERMS

These Terms of Service (“Terms”) constitute a legally binding agreement between you and M.E.L.T. Myotherapy & Massage LLC (“M.E.L.T.,” “we,” “us,” or “our”). By using our website, booking services, or receiving our services, you agree to be bound by these Terms.

**Please read these Terms carefully. If you do not agree to these Terms, you may not use our services.**

## 2. ABOUT OUR SERVICES

M.E.L.T. Myotherapy & Massage is a licensed massage therapy practice located in Livonia, Michigan. We provide therapeutic massage services at our studio location. Our practice is licensed in accordance with Michigan state regulations, and our licensing information can be verified through the Michigan Department of Licensing and Regulatory Affairs (LARA).

**Important Notice:** Our massage services are for therapeutic, wellness, and relaxation purposes only. We do not provide medical treatment, diagnosis, or medical therapy. References to “therapy” in our business name refer to massage therapy, not medical therapy.

## 3. ELIGIBILITY AND AGE REQUIREMENTS

- You must be 18 years or older to book services independently

- Clients under 18 must have a parent or legal guardian present during treatment

- Senior clients with memory concerns may require a caregiver to be present

- Medical clearance may be required before beginning or continuing treatment in certain circumstances

## 4. BOOKING AND PAYMENT

### Booking Process

- Appointments may be booked through our online booking system (Acuity Scheduling), by phone, or by email

- All bookings are subject to availability and confirmation

- You are responsible for providing complete and accurate information when booking

### Payment Terms

- We accept cash, major credit cards, debit cards, checks, and gift cards

- Payment may be made at time of booking, in advance, or at time of service

- Gift cards are available for purchase

- Services are not subject to sales tax, but products including digital products and tickets are.

- **Gratuity:** Tips are greatly appreciated and help support our small business. You may add gratuity to card payments or provide cash tips directly

### Pricing

- Current pricing is available on our website and booking system

- We strive to provide at least one week notice for any price changes

- **Promotional Pricing:** Special offers and promotional rates may be available for limited times and are subject to specific terms and conditions

- Gift cards and service packages may have separate expiration dates as specified at time of purchase

## 5. CANCELLATION AND RESCHEDULING POLICY

### Cancellation Policy

- **24-hour notice required:** Cancellations must be made at least 24 hours before your scheduled appointment

- **Late cancellations:** Cancellations made with less than 24 hours notice will be charged 50% of the appointment fee

- **No-shows:** Failure to attend your appointment will result in a charge of 100% of the appointment fee

- **Payment of fees:** Cancellation and no-show fees must be paid the same day as the missed appointment

### Rescheduling Policy

- **48-hour notice required:** Rescheduling requests must be made at least 48 hours before your scheduled appointment

- **Late rescheduling:** Rescheduling with less than 48 hours notice may incur additional fees

- **Rescheduling outside regular business hours:** Additional fees apply for rescheduling requests made outside of business hours. This does not apply to you contacting me, please contact me via text or e-mail available 24/7.

### Refund Policy

- **Gift cards:** No refunds available on gift card purchases

- **Service packages:** Have separate terms and expiration dates as specified at purchase

- **Prepaid appointments:** No refunds on prepaid services - clients must cancel or reschedule within our cancellation/rescheduling policies

- **No-show on prepaid appointments:** Prepaid amounts are forfeited with no refund

- **Fee application:** Any existing account balance or prepaid amounts will be applied first to cover cancellation fees or no-show charges, with any remaining balance applicable to future services

- **Outstanding balances:** Any fees not covered by existing credits are due at your next appointment

## 6. CLIENT RESPONSIBILITIES

As a client, you are responsible for:

- Providing accurate health information and disclosing any medical conditions

- Arriving on time for your appointment

- Informing us of any changes to your health status

- Following pre and post-treatment recommendations

- Maintaining appropriate behavior and communication

### Health Information

- You must disclose any medical conditions, injuries, or medications that may affect your treatment

- Failure to disclose relevant health information may result in treatment modification or cancellation

- If contraindications are discovered during treatment that were not previously disclosed, treatment may be terminated with full payment due

## 7. LATE ARRIVALS AND EXTENSIONS

### Appointment Timing

- Please arrive at your scheduled appointment time - not early or late. You may wait in the upstairs or front lobby if you arrive early but I cannot guarantee that I will have the room available to start you early.

- Your appointment time includes up to 15 minutes total for intake processes before treatment and checkout procedures after treatment

- Arrivals more than 10 minutes late may result in shortened treatment time without fee adjustment

- Excessive lateness may result in appointment cancellation with applicable fees

### Treatment Extensions

- Extensions are subject to therapist availability and your preference

- Additional time will be charged at current rates

- Payment for extensions may be made at time of service

## 8. PROFESSIONAL CONDUCT AND BOUNDARIES

### Our Commitment

- We maintain professional boundaries at all times

- All treatments are conducted with appropriate draping and professional standards

- We provide a safe, respectful environment for all clients

## Client Conduct

- Inappropriate behavior, sexual advances, or harassment will not be tolerated

- Clients engaging in inappropriate behavior will be asked to leave immediately with no refund

- Serious misconduct will be reported to local authorities

### Zero Tolerance Policy

We have a zero tolerance policy for:

- Sexual harassment or inappropriate behavior

- Discrimination or hate speech

- Threats or aggressive behavior

- Drug or alcohol use on premises


## 9. PRIVACY AND DATA USE

### Information Collection

- We collect personal and health information necessary to provide our services

- Information is stored securely and in compliance with HIPAA regulations where applicable

- We may use automated systems and AI tools to help manage communications and scheduling

### Marketing Communications

- We may send appointment reminders, health tips, and promotional emails

- You may opt out of marketing communications at any time

- Appointment reminders and service-related communications will continue as necessary

### Third-Party Services
We use trusted third-party services including:

- Acuity Scheduling for appointment booking

- Stripe for payment processing

- Squarespace for email marketing

- AI tools for content creation and customer service support

## 10. INTELLECTUAL PROPERTY

All content on our website, marketing materials, and communications, including text, images, logos, and designs, are the property of M.E.L.T. Myotherapy & Massage or our licensors and are protected by copyright and trademark laws.

## 11. LIMITATION OF LIABILITY

To the maximum extent permitted by Michigan law:

- Our liability is limited to the amount paid for services

- We are not liable for indirect, consequential, or punitive damages

- We do not guarantee specific health outcomes from our services

- We are not responsible for injuries resulting from failure to follow post-treatment recommendations

**Exceptions:** Nothing in these terms limits our liability for:

- Death or personal injury caused by our negligence

- Fraud or fraudulent misrepresentation

- Any matter where liability cannot be lawfully limited

## 12. FORCE MAJEURE

We are not liable for inability to provide services due to circumstances beyond our control, including but not limited to:

- Natural disasters, severe weather

- Government orders or public health emergencies

- Technical failures or power outages

- Other unforeseeable events

In such cases, we will work to reschedule appointments when possible.

## 13. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website with the revision date. Continued use of our services after modifications constitutes acceptance of the updated Terms.

## 14. DISPUTE RESOLUTION

### Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.

### Jurisdiction

Any disputes arising from these Terms or our services will be resolved in the courts of Wayne County, Michigan.

### Alternative Dispute Resolution

Before pursuing legal action, parties agree to attempt resolution through:
